A battery protection apparatus and a battery protection method using the same recognize and prevent overcharging detection decrease in a battery protection circuit due to abnormal venting or frequent overcharging by detecting an excess increase in inner pressure of a cell in a secondary battery. According to an embodiment of the present invention, the battery protection apparatus comprises: a battery module including a unit cell, a conductor case, a positive electrode, and a negative electrode; a positive electrode power line connected to the positive electrode; a negative electrode power line connected to the negative electrode; a signal line connected to the case; and a battery protection circuit for measuring charging voltage of the unit cell measured through the positive electrode power line and the negative electrode power line, measuring detecting voltage of the unit cell measured through the negative electrode power line and the signal line, and determining a charging status by using a calculated voltage ratio of the charging voltage and the detecting voltage. |
