PROBLEM TO BE SOLVED: To provide an optical resin composition having excellent non- birefringence, heat-resistance, low hygroscopicity and releasability from a mold and provide an optical element produced by using the composition. SOLUTION: The non-birefringent resin composition for optical use is produced by the copolymerization of 5-40 pts.wt. of a methacrylic acid ester or acrylic acid ester having a 5-22C alicyclic hydrocarbon group at the ester part, 50-80 pts.wt. of methyl methacrylate, 5-40 pts.wt. of an N-substituted maleimide, 0-30 pts.wt. of benzyl methacrylate and 0-10 pts.wt. of a monomer copolymerizable therewith (the sum of the monomers is 100 pts.wt.) at compositional ratios to get a resin having an absolute value of the orientation birefringence of <1×10-6 and contains <=0.6 wt.% volatile component and 0.05-2.0 wt.% fatty acid amide or fatty acid ester (based on the total weight of the monomers) having an endothermic peak at >=70 deg.C by differential scanning calorimetry. The element for optical use is produced by using the composition.
