PURPOSE: To realize high quality variable rate data transmission based on rate detection of high accuracy while reducing overhead with the idea of blind rate detection not to transmit rate information. CONSTITUTION: Frame data including transmitted data and a calculated error detection code is generated when the transmitted data exists, frame data including no piece of the transmission data and the error detection code is generated and transmitted when no transmitted data exists in each frame on the transmitting side. One or more final bit positions of the frame data are assumed, the transmitted data, the error detection code are assumed respectively and the error detection code of the assumed transmitted data is calculated in the respective frames on the receiving side. When the position where the assumed error detection code coincides with the calculated error detection code calculated based on the assumed transmitted data exists, the position is judged as the final bit position and when no coincident position exists, no piece of transmission data is judged to exist or an error is judged to exist in the received frame data.
