PROBLEM TO BE SOLVED: To provide an earthquake mitigating device for a structure that recycles a waste tire and in inexpensive, structurally simple and easily replaceable. SOLUTION: The earthquake mitigating device with a used tire recycled is fixed between base concrete 7 and a frame (sill). With a tire 1 laid horizontally, two holding plates 3 hold the upper and lower surfaces of the tire in between from above and below so as to bite on inside-diameter flange portions of the tire adapted to fit in a wheel. A steel ball 4 is disposed between the centers of the upper and lower holding plates, and is continuously spring-loaded into the center. Bolts are fixed to the external centers of the upper and lower holding plates.
