PURPOSE: An apparatus and method for determining the transmission rate of adaptive packet data and modulation and demodulation parameters in a mobile communication system for voice and packet data services is provided to simultaneously perform a voice conversation and the transmission of forward packet data with a maximum transmission rate by suitably changing the demodulation parameters of a channel in a terminal according to the number of usable orthogonal(Walsh) code and changing the modulation parameters of the channel in a base station. CONSTITUTION: A CIR(Carrier to Interference Ratio)-Rm(maximum transmission rate) mapping table(1109) stores a certain maximum transmission rate corresponding to a certain CIR. A mobile station data rate controller(1105) obtains the maximum transmission rate stored in the CIR-Rm mapping table(1109) corresponding to CIR measured through a pilot channel and adjusts a symbol repetition rate according to the obtained maximum transmission rate and orthogonal code information assigned to a base station.
