PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor having sufficient mechanical characteristics, high solubility with a non-halogen solvent and excellent electric characteristics, particularly responsiveness. SOLUTION: In the electrophotographic photoreceptor having at least a photosensitive layer on a conductive substrate, the binder resin of the photosensitive layer contains a polyallylate structure expressed by general formula (1). In formula (1), X is a bivalent organic group having aromatic rings except for the structure expressed by formula (2) and m and n satisfy 1>m/(m+n)>=0.5.
