PROBLEM TO BE SOLVED: To provide a lactic acid copolymerized polyester having excellent impact resistance and biodegradability. SOLUTION: In this invention, an aliphatic polyester and a lactide are mixed so that they may separate into two layers and stirred so that they may form an emulsion, then a ring-opening polymerization catalyst is added and the mixture is stirred and copolymerized. As a result, a lactic acid copolymerized polyester including the micro phase-separated structure that is characterized by having (B) islands of the dispersion phase (II) of the polylactic acid structural units in the continuous phase (matrix) (A) of the aliphatic polyester, further the aliphatic polyester structural units (A) are dispersed in the spherical phases (III) in the dispersion phase (II) is given and the copolymer has excellent impact resistance.
