PROBLEM TO BE SOLVED: To provide a photoreceptor and an image forming device in which melt sticking of toner during cleaning is prevented and formation of good images is maintained. SOLUTION: In the electrophotographic photoreceptor produced by successively laminating a photoconductive layer 102 containing amorphous Si and a surface protective layer 103 consisting of an amorphous material on a conductive substrate 101, the refractive index is stepwise or continuously varied between the photoconductive layer 102 and the surface layer 103. The center line average roughness Ra1 on the interface of the photoconductive layer in the surface side in 10μm×10μm area and the center line average roughness Ra2 of the outermost surface of the surface layer are controlled to satisfy Ra1/Ra2>=1.1 and 22<=Ra1<=100 nm.
