PROBLEM TO BE SOLVED: To provide a biodegradable and recycled polyester resin using a recycled aromatic polyester, being inexpensive and economical and further capable of solving a waste problem by imparting biodegradability to the aromatic polyester conventionally supposed not to have the biodegradability, and a production method thereof. SOLUTION: The biodegradable and recycled polyester resin is produced by imparting the biodegradability to the recycled aromatic polyester (A), and is featured by being produced by reacting an aliphatic polyester (B) having 3,000-300,000 of number-average molecular weight with the recycled aromatic polyester (A) at a reaction ratio (weight ratio) of (A)/(B)=95/5-5/95.
