PROBLEM TO BE SOLVED: To prevent that the information signal ought to leave is erased when the previously recorded signal is in existence, since the recording of the information signal of the capacity equal to or smaller than that of a storage means for storing the information signal to be recorded is conventionally made by erasing a track in the amount of capacity of the storage means. SOLUTION: By a control means 14 monitoring the storage amount of a buffer 20, an optical disk 11 is settled to the reproduction still state till the storage amount reaches the data amount for one track length or longer, and when the data amount for one track length or longer is reached, after a still scanning one track is erased, the data read out from the buffer 20 are recorded on the erased one track. At the time point when the recording is finished, the discrimination is made by the control means 14 whether the storage amount of the buffer 20 again reaches the data amount for one track or larger, and when it is reached, the erasure of the one track and the write-in to the erased track are carried out, while the reproduction still state is settled when not reached.
