PROBLEM TO BE SOLVED: To provide a congestion state notice method and system where a transition frequency of a congestion state level is high and a transition notice may be a bottle neck at an enhanced throughput. SOLUTION: This invention provides a congestion state notice method adopting a system that informs an upper stream side of a buffer about a congestion state level every time transition of the congestion state level discriminated from a resident packet amount in the buffer is detected and that uses a different discrimination threshold value corresponding to the transition direction in the case that the congestion state level has been detected.
