PURPOSE: A backward data transmission method and system in a mobile communication system are provided to effectively perform an overload controlling of a base station of a high speed data transmission system to ensure a performance of a system and a capacity by having an effective data transfer rate controlling method of a reverse link of a mobile station unit. CONSTITUTION: When a mobile station accesses an initial reverse link, it maintains a transfer rate of 9.6 kbps(200). After setting the reverse link of 9.6 kbps, the mobile station receives a ReverseRateLimit message(202) and analyzes it(204). The mobile station compares an allocated data transfer rate and a transfer rate of the currently transmitting reverse link(206). If the current transfer rate is greater than the allocated transfer rate in the ReverseRateLimit message, that is, when the mobile receives an instruction to lower the transfer rate from a base station, the mobile station reduces the data transfer rate and transmits a data through the reverse link(212). When the data transfer rate is completely set, the mobile station transmits the data through the reverse link and continuously monitors a forward MAC channel(214-216). When the mobile receives an RAB, the mobile station checks whether the received RAB has been set as '1'(218). If a control channel of at least one sector among an Active Sets, that is, the RAB of a forward MAC channel has been set '1', the mobile terminal checks whether the current transfer rate is above 19.2 Kbps(228). If the current transfer rate is above 19.2 Kbps, the mobile station checks whether an Ignore_RAB has been set as '1'(232). If the transfer rate is above 19.2 Kbps, the mobile station reduces the data transfer rate of the reverse link to half(234).
