PROBLEM TO BE SOLVED: To execute the on-line identification to improve the muffling effect. SOLUTION: In this active muffler having a means for operating a detecting signal from a first noise detecting means mounted on a duct communicated to an exhaust pipe of a diesel engine, for interfering and muffling the same by a signal from a muffling signal output means mounted at a downstream side of the duct, detecting the muffling effect by a second noise detecting means mounted at its downstream side, and updating an evaluation value of a sound transmitting function from the muffling signal output means to the second noise detecting means, to operate a muffling signal, a means for detecting a rack position is mounted on a governor of the diesel engine and connected with the operating means to update the evaluation value for controlling the muffling, when the amount of the changes of the rack position is above a predetermined value. In a case of a gasoline engine, the amount of the changes of a throttle opening is detected, and the evaluation value is updated for controlling the muffling, when the amount of the changes is above the predetermined value.
