PROBLEM TO BE SOLVED: To easily produce a diffraction optical element with a relief pattern free from bubbles. SOLUTION: The diffraction optical element has at least two different 1st and 2nd laminated optical materials 3, 4 which are substantially transparent in a wavelength band used and a relief pattern 5 is formed on the boundary face of at least the 1st optical material 3. The optical element also has a covering material fitting part 7 situated on the outside of the effective surface of the relief pattern 5 and a covering material 6 which is substantially transparent in the wavelength band used, is joined to the part 7 and laminated oh the 2nd optical material 4.
