PURPOSE: To provide a disk recording and reproducing device having a function stopping a recording while detecting an ineffective recording state such as a silence. etc., and a function separating an ineffective recording part from an effective recording part. CONSTITUTION: In a disk recording and reproducing device which a disk 1-16 having a program area capable of the recording and reproducing and an UTOC area is made to be a recording medium, a recording control is performed by a system controller 4 based on the detection output of a level detector 3 detecting voice levels indicated by audio data to be recorded in the program area. Then, the recording of audio data is stopped in a case that a time when a voice level is lower than a prescribed level reaches a prescribed time and UTOC data to be recorded in the UTOC area are rewritten so that data for a prescribed time in the final part of audio data are divided as data for other musics.
