PROBLEM TO BE SOLVED: To appropriately record new data by exactly detecting the recordable position of the new data in a short time when these new data are recorded after the pseudo erase is carried out for the data with respect to an optical recording medium whereon the data are recorded to the track in a packet unit. SOLUTION: The data are recorded to the track of the optical recording medium in a packet unit, and these data are subjected to pseudo erase by erasing the index information of the track whereon the data are recorded, then the information showing the final position of the packet whereon the data are recorded, is recorded on the optical recording medium, and the new data are recorded to the track, the data on which are subjected to pseudo erase, based on the information showing the final position of the packet.
