PROBLEM TO BE SOLVED: To provide a transfer device and an image forming device, capable of thoroughly absorbing an impact generated, when a paper rushes into a nip part and when the paper is separated from the nip part by using a moving means, and capable of forming a proper image. SOLUTION: The device is provided with a press-contact means for bringing a transfer member into press contact with an image carrier or an intermediate transfer body, while controlling the transfer member so as to come into press contact or separate from the image carrier or the intermediate transfer body, the moving means for supporting the transfer member, so as to be rocked and rocking the transfer member according to an external force generated at a process of bringing the recording medium to the press-contact part of the image carrier or the intermediate transfer body with the transfer member, and a positioning means for positioning the rocking direction of the transfer member, so that the rocking direction may be always kept constant with reference to the press-contact direction of the image carrier or the intermediate transfer body with the transfer member.
