PROBLEM TO BE SOLVED: To provide an antibacterial, antifungal polymer which has high effects for controlling bacteria and fungi and has high thermal stability, high time stability and high safety, and to provide a resin composition containing the polymer. SOLUTION: This antibacterial, antifungal polymer obtained by polymerizing monomers containing an alkenyl benzoate represented by the formula (1) (R1 is H, OH, a halogen or an alkyl; R2 is a 2 to 3C alkenyl) in an amount of 30 to 100 wt.%, characterized by having a number-average mol.wt. of 2,000 to 20,000, a sterilization rate of >=70% by an antibacterial test and a hypha growth range rate of <=10% by a resistance test. And, the antibacterial, antifungal resin composition obtained by compounding the polymer into another thermoplastic resin.
