PURPOSE: A copy protect optical manufacturing method and an optical disk thereby are provided to protect a copy and an operation of a copied optical disk, and to finish all processes for a copy protect in a manufacturing process by inserting OHD(Optical Head Ditching) data into a specific region of the optical disk, and to increase a reliability of the copy protect by combining a copy protect hardware of the optical disk and an encryption and authentication technology software. CONSTITUTION: Under a pre-mastering process, a formatting work for inserting an OHD(Optical Head Ditching) information layer, a driving program, and a production identifier is performed(102). At this time, the OHD information layer includes the location information of a sector pertinent to a next read OHD region and the location information of a sector where next read valid data are stored, and the driving program is distributed and stored at the OHD information layer, and the production identifier identifies a content. Next, under a mastering process, a stemper is made by using the formatted signal(104). At this time, the stepper includes more than one OHD region in which a tracking of optical beam is impossible in the time of playback of the optical disk inside an optical disk playback device. Through this process, an OHD data block is built up, and not only a valid data block but also the OHD data block are written on a disk original plate by a laser cutting. After this, a pressing work is performed by using the stemper, and the pressed disk is bonded, and finally a copy protect optical disk is manufactured(106).
