PROBLEM TO BE SOLVED: To provide a nonaqueous electrolyte battery having an excellent cycle characteristics when graphite material is used for a negative electrode while keeping the improved initial capacity and the excellent high temperature storage characteristics. SOLUTION: This battery is provided with a negative electrode 1 having carbon material capable of being doped with and being cleared of lithium as a negative electrode active material, a positive electrode 2 having a complex oxide of lithium and transition metal as a positive electrode active material, nonaqueous electrolyte containing at least nonaqueous solvent and electrolyte. The nonaqueous electrolyte contains acetonitrile more than or equal to 0.01 volume % and less than 1 volume %.
