PURPOSE: A travel preventive device and a method thereof are provided to automatically release a parking brake by detecting travel in locking the parking brake, and to alarm to a driver properly. CONSTITUTION: A travel preventive apparatus in locking a parking brake is composed of an engine start detecting unit(10), a vehicle speed detecting unit(20), an accelerating pedal operation detecting unit(30), a parking brake lever(40), a parking brake switch(50), a parking brake unit(60), a temperature detecting unit(70), a control unit(80), an actuator(90), and first and second warning lights(L1,L2). Starting condition of an engine is detected, and vehicle speed is detected in starting the engine. The temperature of the parking brake unit at a wheel is detected at vehicle speed over the specific temperature. The parking brake is forcibly released with operating the actuator in case of the temperature of the parking brake unit to be over the reference value.
