PURPOSE: A use preventive device of a mobile phone for a vehicle and the preventive method is provided to prevent the use of a mobile phone when fueled, by detecting whether a vehicle is fueled or not through an external gas sensor and a mobile phone is used or not through an electric wave sensor, and maximizing the volume of an audio system. CONSTITUTION: A gas station sensor(11) detects whether a vehicle is at a gas station or not. An electric wave sensor(13) senses the radio wave of a mobile phone emitted on a vehicle traveling. A control part(20) outputs the control signal to interrupt the mobile phone use when a vehicle is at a gas station by analyzing the signal. An audio system(30) maximizes the audio volume, receiving the control signal to interrupt the mobile phone use.
