PURPOSE: An abnormal acceleration preventing device using a brake oil pressure and the method thereof prevent the occurrence of a safety accident due to an abnormal rapid acceleration phenomenon. CONSTITUTION: If the position of a change lever is on a parking or a neutral range when the key switch of a vehicle having an automatic transmission is on an ignition terminal, a brake oil pressure is controlled to operate a brake system(5). If the key switch is on a reverse, a drive, a slow or a low speed range, the operation of the brake system(5) is automatically released such that an abnormal rapid acceleration phenomenon is prevented without adding any separate parts. Thus, the occurrence of an accident due to the abnormal rapid acceleration phenomenon is prevented.
