PURPOSE: An apparatus and method for extracting a background level of a facsimile are provided to decide a crystal critical value used for processing a brightness level of data transmitted through a facsimile variably. CONSTITUTION: A critical value storing unit(10) stores critical values corresponded to 'n' numbers partitions which divide a range being possessed by a brightness level of a pixel corresponded to a message or/and a background transmitted through a facsimile. Also, the critical value storing unit(10) responds one critical value out of the stored critical values to a control signal output from one control unit(12) and reads to the control unit(12). The first comparator(14) compares the brightness level of the pixel inputted through an input terminal(IN) with a crystal critical value output from the control unit(12), and outputs the compared result to a counter(16). A counter(16) performs a downward or upward counting operation by responding to the compared result, and outputs the most significant bit(MSB) of the counted result to the control unit(12) as a sign bit. Also, the counter(16) outputs the counted result to the second comparator(18).
