PURPOSE: An overload control apparatus between call control agent and gateway in communication network and the method thereof are provided to perform an overload control according to the overload generation state when generating overload in the call control agent/gateway, thereby making the service to be interrupted or temporarily the call request to be interrupted, and temporarily the service to substituted call control agent/gateway to be converted. CONSTITUTION: A call control agent unit includes the first call control agent(110) having the priority to the gateway control right and the second call control agent(120) for performing a gateway control and a call control instead of the first call control agent when generating overload. An overload server(115) performs an overload state supervision and a service suspension to each call control agent and gateway. Call controllers(113,123) are installed to each call control agent and gateway and performs a call control role by controlling the gateway. Overload clients(117,125) are installed to each call control agent and gateway and reports the overload state to the overload server.
