PROBLEM TO BE SOLVED: To provide a compact and simple fermentation device which an efficient methane fermentation allows and is the recovery and effective utilization high-concentration gaseous methane because the device excels in the function to prevent the intrusion of dissolved oxygen into a fermentation tank and a function to suppress the denitrification reaction in fermentation tanks (the function to lower the concentration of nitric acid ions and the concentration of nitrous acid ions) and a waste water treating device using such fermentation device. SOLUTION: This fermentation device A consists of >=1 initial settling tank 2 into which organic waste water flows and the >=2 fermentation tanks 7 and 9 connected to this initial settling tank 2 and has the structure that the fermentation gas generated from the final fermentation tank 9 is introduced into the fermentation tank 7 connected earlier than the final fermentation tank 9 and is recovered from this fermentation tank 7. The waste water treating device B is constituted by connecting an aeration tank 15 or anaerobic tank 14 and the aeration tank 15 or the anaerobic tank 14, the aeration tank 15 and the final settling tank 17 behind the final fermentation tank 9 of the fermentation device A.
