PROBLEM TO BE SOLVED: To provide a press member where being electrified by friction is surely prevented and a high durability is realized without lowering its releasing ability and a fixing device provided with it and to stably provide a fixed image of high definition where transfer material such as paper being wound up by a press roll, an image failure such as tailing of an electrostatic offset line and an image failure due to soiling by toner on a surface of the press roll are prevented. SOLUTION: In the press member constituting a fixing part by forming a pair with a rotating body integrated with a heat source and installed in state of a pressurized contact with one part of the rotating body above to hold in between and carry the transfer material carrying an unfixed image to the fixing part above and to fix the image above, at least more than 2 layers of a layered construction including an elastic layer and a releasing layer is provided and organic phosphate is contained at least within the releasing layer above and the fixing device provided with the press member above.
