PURPOSE: A Rx(Received) data sampling apparatus for power control in a mobile communication system and a method thereof are provided to detect the current channel status depending on a sampling timing error signal from a TTL(Time Tracking Logic) block, and to control a sampling position in an Rx data sector by a threshold or by a feedback information from the TTL block. CONSTITUTION: The apparatus comprises an AGC block(520) for controlling a power of a mobile station using an average energy(570) obtained by sampling at a proper sampling position in the Rx data sector when a SPCS(Sampling Position Control Signal)(550) is inputted from a CSD(Channel Position Detector)(510). The TTL block(530) detects a proper sampling position and/or a sampling timing error so that a high level processor decodes the Rx data at the proper sampling position. The CSD detects the current channel status using either a time tracking information in a timing error signal(560), SNR(Signal to Noise Ratio) or RSSI(Received Signal Strength Interference) from the TTL block.
