PROBLEM TO BE SOLVED: To obtain a data transferring device, a network using this data transferring device and a data communication method, which can use the band of the network as effectively as possible and minimizing the omission of a data packet for transferring. SOLUTION: A data communication method in a data transferring device 1 is connected between plural external networks and an internal network 2 for switching a data packet from these external networks 3 and is provided corresponding to the plural external networks 3. At the time, the data packets from the networks 3 are received, the received data packets are sorted corresponding to a path connecting with the device 1 of a transferring destination and then, the sorted data packets are stored in a queue, the stored data packets are multiplexed within the range of a maximum band previously set to the path corresponding to the queue to be transmitted to the network 2.
