PURPOSE: A data detector and a method thereof are provided to make the phase of sampling points of input signals that are data detection points and the phase of an optimum detection point of actual playback signals adaptively coincide with each other, when maximum-likelihood decoding playback data, so as to prepare against the variable playback signals and have optimum performance. CONSTITUTION: In a data detector(300), an A/D(Analog-to-Digital) converter(302) converts received signals into digital data according to a sampling clock signal. A digital viterbi decoder(304) performs maximum-likelihood decoding for the digital data. A phase detecting and error voltage generating unit(306) detects a phase difference between the digital data sampled in one detection point of predetermined optimum detection points of the received signals and each reference level according to the optimum detection points. And the phase detecting and error voltage generating unit(306) generates a control signal to shift the phase of the sampling clock signal according to the detected phase difference. And a clock shifter(308) shifts the phase of the sampling clock signal according to the control signal of the phase detecting and error voltage generating unit(306).
