PROBLEM TO BE SOLVED: To obtain a resin layer having high mechanical strength even at high temperature and high humidity and at low temperature and low humidity by providing a specified degree of swelling to the resin layer containing a siloxane-base resin having a structural unit with electric charge transferring performance and also having a crosslinked structure. SOLUTION: The electrophotographic photoreceptor has a resin layer containing a siloxane-base resin having a structural unit with electric charge transferring performance and also having a crosslinked structure. The degree of swelling of the resin layer in methanol is <=10%, preferably <=7%. The siloxane-base resin is a siloxane resin having a chemical structure with such characteristics as to exhibit drift mobility of electron or hole incorporated as a partial structure and it is produced by a known method using an organosilicon compound having a hydroxyl group or a hydrolyzable group. The degree of swelling is controlled by varying the curing temperature and time of the resin layer, the kind of silicone compound for forming the siloxane- base resin, the number of functional groups in the compound and the kinds of other additives.
