PROBLEM TO BE SOLVED: To obtain a recording and reproducing device capable of performing an original ordinary recording and also capable of preventing overwriting if necessary. SOLUTION: In this device, a CTL leading reproducing head 6 which is to reproduce a control signal is arranged on the more upstream side in the traveling direction of a recording medium 1 than a recording and reproducing head 8 and a control head 9, and the device is provided with a mode selecting means 26 for selecting either one of an ordinary recording mode allowing overwriting on the area where signals are already recorded on a recording medium 1 or an overwrite recording prevention mode preventing the overwriting on the area, and a control means 10 for controlling recording and reproducing operations by an erasing head 7, the head 8 and the head 9 in accordance with the selection of the ordinary recording mode or the overwrite recording prevention mode by the means 26 and the presence or absence of a control signal which is reproduced by the head 6.
