PROBLEM TO BE SOLVED: To determine a background image while taking variation in the luminance of a background image in the temporal direction into consideration even in such a case by extracting a set area of pixels included in the luminance level distribution range of a determined moving picture object as the image area of the moving image object in each frame image. SOLUTION: A luminance histogram generating circuit 1 generates a time- directional luminance histogram of pixels of a moving picture. A moving picture object luminance level range determining circuit 3 determines as the luminance level distribution range of the moving picture object of pixels the luminance level distribution range of a complementary set part in a range obtained by expanding a luminance level distribution range nearby the most frequent value of the time-directional luminance histogram of the pixels generated by the circuit 1. A moving picture object image area extracting circuit 6 extracts as the image area of the moving picture object of each frame image the set area of the pixels included in the luminance level distribution range of the moving picture object determined by the circuit 3 among the pixels of each frame image.
