PROBLEM TO BE SOLVED: To obtain an optical device having a high correcting effect to make corrections for aberration and easy to produce, an optical head using the optical element and an optical recording and reproducing device. SOLUTION: The optical device includes a 1st substrate 11, a 2nd substrate 12 disposed nearly parallel to the 1st substrate 11, a voltage applying electrode 13 disposed between the 1st substrate 11 and a liquid crystal and a counter electrode 14 disposed between the 2nd substrate 12 and the liquid crystal in such a way that the counter electrode 14 confronts the voltage applying electrode 13. The phase of light incident on the liquid crystal is changed by varying the voltage difference between the voltage applying electrode 13 and the counter electrode 14.
