PROBLEM TO BE SOLVED: To provide the electrophotographic photoreceptor superior in the durability and adhesion between its surface protective layer and a photosensitive layer by forming the surface protective layer made at least of polysiloxane and a viny resin having silyl groups. SOLUTION: The electrophotographic photoreceptor formed by laminating the photosensitive layer and the surface protective layer in this order on a conductive substrate, and this surface protective layer contains the vinyl resin comprising at least polysiloxane and silyl groups, preferably, this layer comprises the polysiloxane chemically combining with the silyl group of vinyl resin having the silyl groups. This polysiloxane comprises plural siloxane bonds in series and, preferably, three-dimensionally combined structures of them.
