PROBLEM TO BE SOLVED: To provide an earthquake-resistant heat insulating panel having an increased wall index and having earthquake resistance made very high so as to attain strength with which it can resist even compressive deformations, and to provide an earthquake- resistant heat insulating structure using the same. SOLUTION: This earthquake-resistant heat insulating panel 1 comprises a generally rectangular plate-shaped heat insulating material 2 divided into two along its diagonals and designed to be capable of expanding and contracting in a direction perpendicular to the dividing diagonals 3, with an elastic member 5 interposed between the dividing diagonals 3, inside a square framework space surrounded on four sides by vertical members, such as columns 10 and studs, a sill 9, and horizontal members, such as beams, furring ships and girders. The earthquake-resistant heat insulting panel 1 is fitted in place inside the framework space by causing contraction of the plate-shaped heat insulating material 2 in directions perpendicular to the dividing diagonals 3; the plate-shaped heat insulating material 2 is then expanded in the directions perpendicular to the dividing diagonals 3 and the ends of the plate-shaped heat insulating material 2 on the dividing diagonals 3 are locked by means of locking members to the vertical and horizontal members which constitute the framework space.
