PROBLEM TO BE SOLVED: To enable the reproducing operation without giving any influence on reproduction of data stream due to a pit stream and disable the illegal copying operation by displacing the pits in the internal and external circumference directions of an optical disk and recording a sub-data of the key data. SOLUTION: A laser beam L3 collecting position is sequentially shifted to the external circumference side from the internal circumference side of an original disk 2 to form the spiral track on the original disk 2. Moreover, the pit stream is sequentially formed depending on the EFM signal S2 along the track by ON/OFF control of the laser beam L1 with an optical modulator 8A depending on the EFM signal S2. Moreover, the emitting direction of the laser beam L2 is sequentially displaced with an optical deflector 8B to displace the pit in the internal and external circumference directions of the original disk 2 depending on the key modulation signal KS. Thereby, the encrypted audio signal can be recorded and the key data KY for canceling encryption of audio data can also be recorded.
