PURPOSE: A cationic surfactant using N-alkyl polyhydroxyl amine is provided which is biodegradable as well as less irritative on human body. Therefore, said surfactant is applicable as a form of fabric softener and/or rinse. Also a preparation method thereof which is carried out under simpler process conditions at high yield rate is provided. CONSTITUTION: A cationic surfactant using N-alkyl polyhydroxyl amine characterized by incorporating chemical formula 1 and chemical formula 4, wherein R1 is alkyl group having 1 to 4 of carbon atom, R2 and R3 is respectively straight or branched alkyl group, alkenyl group, ester-alkyl group, or ester alkyl group having 1 to 22 of carbon atom, Z is straight polyhydroxy alkyl group having at least 3 hydroxy groups, and X is halogen ion, is provided. The formula 1 is prepared by reacting N-alkyl polyhydroxyl amine with double or triple equivalent of alkyl halide compounds based on N-alkyl polyhydroxyl amine equivalent. In the preparation method of the formula 1, tertiary amine represented by formula 3 is obtained in case that N-alkyl polyhydroxyl amine reacts with the same or a little higher equivalent of alkyl halide compounds based on N-alkyl polyhydroxyl amine equivalent. The cationic surfactant using N-alkyl polyhydroxyl amine is prepared both by reacting said tertiary amine with alkyl halide compounds and by reacting said tertiary amine with dihalide.
