PROBLEM TO BE SOLVED: To provide a soundproof heat insulating member with a vacuum layer capable of maintaining the degree of vacuum of the vacuum layer over a long period, excellent in soundproof performance and heat insulation performance, capable of being easily enlarged, and kept thin, lightweight and excellent in strength after being enlarged and provide a soundproof heat insulating construction material incorporating it. SOLUTION: This soundproof heat insulating member 1 with a vacuum layer has a spacer 3 kept in point contact or line contact with two metal sheets in a metal case 2 oppositely arranged with two metal sheets at a slight interval and sealed on the peripheral edge, and the inside of the metal case 2 is made vacuum. The soundproof heat insulating member 1 is pinched by two plate-like construction materials formed with lugs on opposite faces respectively to keep two construction materials and the soundproof heat insulating member 1 in point contact or line contact with each other, then the peripheral edge is sealed to form a soundproof heat insulating construction material with a vacuum layer. An ordinary temperature hardening glass ceramic raw material is applied to the outside face and inside face of the soundproof heat insulating construction material or the outside face of the soundproof heat insulating member 1. A gas adsorbent is sealed in the soundproof heat insulating member 1.
