PROBLEM TO BE SOLVED: To eliminate action stoppage by biting of a staple to enable stitching with favorable precision. SOLUTION: A hammer 3 is moved down by a crank rod 26 driven and oscillated by a motor 8 as a drive source, a staple is pushed to a gap S from a line of staples stored in a staple holder 30, and tips of the staple penetrating plural sheets of paper placed on a caulking plate 32 are folded by caulking plate 32 to stitch the plural sheets of paper. The caulking plate 32 is fixed to be positioned to a descending position of the hammer 3, and at the time of overload when plural staples are pushed to the gap S, biting of the staple into the gap S is avoided by move of a staple guide positioned by enegization by a spring.
