PROBLEM TO BE SOLVED: To record or reproduce without damaging the continuity of data by controlling the number of retry times. SOLUTION: The device is provided with a detection means for detecting a defect generated in the data recording area of a recording medium from the number of times in which the data can not be recorded or reproduced on the recording medium, and a changing means for changing the number of times in which the data can not be recorded or reproduced on the recording medium, which is counted when the defect is detected by the detection means in accordance with the amount of the data recording or reproducing unit in the data recording area. When AV data are recorded or reproduced, the number of times of the retry operation performing in the case the defect exists in the data recording area is controlled in accordance with the number of transfer channels of the AV data and the transfer rate.
