PROBLEM TO BE SOLVED: To suppress the increase of traffic by decreasing the number of ATM cells to be excessively generated by suppressing the padding frequency of class 2 as the non-preferential delay class of data or the like. SOLUTION: A selector means 106 selects the short packet of a variable length storing digital signals by delay quality classes, an assembling means 107 assembles the data frame(DF) of prescribed length bytes from that selected short packet, afterwards, an adding means 108 adds an ATM cell header and when the existence of a vacant area in the DF is detected by a state discriminating means 109 in the case of assembling the ATM cell, a threshold value corresponding to the delay quality class of the short packet made into DF is set by a threshold value determining means 113. At the time point when that set threshold value gets equal with the value of a timer started at the time of detecting the vacant area, it is instructed to the means 107 that dummy data are written in the vacant area and the DF is completed.
