PROBLEM TO BE SOLVED: To improve communication quality by preventing feeling of interruption of a voice at a receiving side even when a background noise level is large. SOLUTION: When an input signal frame is discriminated as a section having only a background noise, an estimation power value BNP [K] of a background noise is compared with UPL2 being smaller than the maximum limit value ULP1 of an encoding level of a third encoding section 36 for encoding a background noise by the prescribed level in a background noise level discriminating means 334, it is discriminated whether BNP[K]>=ULP2 or not. When it is BNP[K]>=ULP2, the third encoding section 36 for encoding a background noise is not selected, but a second encoding section 35 is selected.
