PROBLEM TO BE SOLVED: To provide a skew detecting device capable of detecting an accurate skew amount by a simple configuration even in the case of rewritable optical disk and to provide an optical device with the skew detecting function. SOLUTION: This skew detecting device is provided with a light emitting part 31 from which a rotary optical disk 11 is irradiated with the light, which is fixedly arranged with respect to an optical pick-up detecting the light reflected from a signal recording surface of the optical disk, and from which the optical disk surface is irradiated with the light, and a skew sensor 30 which consists of photo-detectors 32 comprising two-split light receiving parts A, B to detect the light reflected from the optical disk and detects a tilt of the optical disk. And, when a skew amount of the optical disk is detected based on the differential signal Sd of the split light receiving parts each, driving parts 38, 39 of the light emitting part compare the summed signal S of each light receiving part with a reference signal Sref, and control to drive the light emitting part so that the summed signal S becomes constant.
