PROBLEM TO BE SOLVED: To efficiently use a region in which data is to be recorded. SOLUTION: In a data recording and reproducing apparatus 10, according to a randomly open instruction, from e server control device, added to a PLAY OPEN command requesting the preparation of the reproducing operation of arbitrary data, control information is changed in such a way that a reproduced region occupied by data in an already reproduced part out of data in a file being reproduced becomes a region which can record new dara randomly together with the reproducing operation of the file. Thereby, for example, when a plurality of data are recorded, the recording region of a data storage part 13 is used with good efficiency when the file being reproduced exists. Before the reproducing operation of the file being reproduced is finished completely, new data can be recorded on a data recording region occupied by the reproduced data.
