A transmission permission rate calculation part 45 increases or reduces an average rate value calculated by an average rate calculation part 43 in accordance with the non- congestion/congestion/double congestion information of the buffer memory which is informed of from the congestion detection control part and an input load value calculated by an input load calculation part 42. An expressional cell rate (ER) writing part control part is informed of the calculated transmission permission rate. The ER writing part control part writes the transmission permission rate in a resource management cell RM as an expressional cell rate(ER).
