PURPOSE:To suppress miswriting in a recorded sector and to accelerating data writing by forming a sector data recording flag in a sector identifying part. CONSTITUTION:The sector data identifying flag having two states, i.e. a recorded state and an unrecorded state, in the sector identifying part. A sector data identifying flag (SDIDF) detecting means 101 outputs a data part recorded/ unrecorded state detecting result to a control means 103 as a SDIDF signal 115 on the basis of the state of the SDIDF and recording sector identifying information 130 and a control means 103 executes the recording/reproducing of an information storing medium 108 on the basis of the signal 115. Consequently, miswriting in the recorded sector can be suppressed and writing in the data part can be accelerated.
