In the present invention, disclosed are an apparatus and a method for encoding an image. More specifically, the image encoding apparatus and the method are an apparatus and a method for ending a mode determination process on encoding modes inside the remaining screen earlier by using information of a block copy mode inside a screen to determine an encoding mode of a current coding unit, or selectively performing encoding mode determination used for determining a mode when the mode determination process does not complete earlier through comparing encoding information between a representative mode of the block copy mode inside the screen and a representative mode of an estimation mode inside the screen.
