PROBLEM TO BE SOLVED: To speedily acquire TOC information at the time of reproducing an optical disk, and to prevent data from being illegally copied at the time of recording them in an optical disk. SOLUTION: Since the optical disk recording and reproducing device records the TOC information in the main channel 113 of a read-in area when writing data to an optical disk, and acquires the TOC information from the main channel 113 of the read-in area when reading out the data from the optical disk, the device is able to obtain a set of sub-coding without collecting data for 98 frames like the case of acquiring the TOC information from a sub-code channel 112, and is able to speedily acquire the TOC information. Moreover, since the device discriminates whether or not the optical disk is copied by whether or not the TOC information is recorded in the main channel 113, and inhibits re-copying, the device is able to prevent the so-called 2nd copy.
