PROBLEM TO BE SOLVED: To provide an optical semiconductor element in which alignment of an optical axis is accurately performed while avoiding cost increase, an optical communication device, an electronic instrument, a manufacturing method of the optical semiconductor element, and a manufacturing method of the optical communication device. SOLUTION: The optical semiconductor element has a semiconductor substrate 10, a light emitting element 20 formed on a plane of the semiconductor substrate 10, and a photoreceiving element 30 that is formed on the plane of the semiconductor substrate 10, and used for at least positioning of the light emitting element 20.
